How Do Workers’ Compensation Lawyers Get Paid?

How do you know you’ll be hurt on the job? You obviously can’t plan for your accident or illness… so when it happens, you are unprepared for the two phases you must go through to get out on the other side with both your health and your financial resources intact.

You have that right! Pennsylvania Workers’ Compensation Law gives you the right to have your medical costs covered. Also, if you are unable to return to work for a period of time, the law also provides for what is called lost wage compensation. In other words, you get paid while you can’t work.

But there is sometimes a roadblock to your recovery. The roadblock comes in the form of the insurance company and your employer. Your injury can cost them thousands of dollars and they aren’t happy about it.

So, what do they do? They look for ways to deny your claim or cut corners to save money on your treatment. They’re subtle about it and make sure they don’t break any laws, but they don’t necessarily tell you the whole story about the benefits you deserve.

Think about this… Your employer and the insurance company have agents, lawyers, doctors, nurses, therapists, and other healthcare professionals they pay to investigate and provide the medical diagnosis that will shape your benefits. Who do you suppose they side with on the close calls?

Then… there is you. You are injured and worried about your health and recovery. Suddenly you become overwhelmed with forms, treatment directions, and legal babble, which all add stress to your recovery. If you are like most people, you become confused. And that’s when you could make a mistake that will end or dilute your benefits.

The answer is simple. Get a lawyer! Using a lawyer is a free resource provided by workers’ compensation law. Why wouldn’t you take advantage of a free professional who is experienced in helping you sort through the legal babble and forms… someone who knows the law as well as the other team does.

Here is just one small word of caution. For some lawyers, “Free” doesn’t always mean totally free. Along with your case come expenses such as the cost for depositions, medical records, professional testimony, and other costs that can total thousands of dollars. Many lawyers expect you to pay those expenses, yourself!

Why do they expect that? The reason is simple. If you win your case, the Judge will order that you be reimbursed for the expenses you have paid. But, if you lose your case, there’s no return of your money.

What does that say about how that lawyer feels about your case? Is it a lack of confidence or a lack of resources to pay the expenses?

Here is how I deal with that situation. I take on the risk and invest in your case by paying all the expenses. I also promise you that, win or lose, you will not ever receive a bill from me. I’ll pay all the expenses, and if we should lose, I’ll take the loss. Your wallet remains in your pocket or purse.
